Non deduction of TDS

24 December 2009 I m providing taxi on hire to a Private Limited Co.

NOw they are not deducting any TDS on the payments made to me. They are also showing the payments towards salary and not against taxi charges

What do i do ?
Is there any penalty comes on me as they are not deducting the TDS on my payments?

How should i show the amount of receipts in my books as they are showing them as salary

24 December 2009 It is the payer who has to comply with the TDS requirements...

The receipent is not concerned with the accounting treatment of the payer.

The receipent should account for the income as per the nature of the business.

Hence in your case you should enter the receipts under the head "Hire Charges Received"
