Late submission of form 112

This query is : Resolved

28 October 2014 I took admission under BCOM from A.U School of distance education in july 2012. I couldnt write first year exams due in may 2013 due to ipcc exams. I registered articles on 10-10-2013. I thought to shift to regular course, but my principal did not allow me do either regular or distance course. He neither signed form 112 nor allowed me write supplementary exams. I didnt write 1st and 2nd year exams. Due to health problem, i took termination from him on 10-7-2014 and re registered articles on 11-7-2014. At that time,i had confusion in continuing BCOM Distance course or to take regular course. So i didnt file form 112 with form103. Now i decided to continue BCOM Distance course and want to appear for supplementary exams conducted this december.

Can i submit form 112 now with condonation fee and letter? If so what reason must i mention in the letter? will my articles affected or there will be delay in my membership?

28 October 2014 1. yes you can submit

2. reason for delay like the form was singed but was misplaced in the office etc., can be given

3. ICAI has a right to delay your membership for the period equivalent to the delay in filing the form.

02 August 2024 It sounds like you're dealing with a complex situation involving the late submission of Form 112 for your B.Com distance education course while completing your articleship. Let me break down the situation and provide guidance on the issues you've raised:

### Key Points and Consequences:

1. **Form 112 Submission**:
- **Late Submission**: You can still submit Form 112 along with Form 103 now, even though it's overdue. The Institute of Chartered Accountants of India (ICAI) allows for late submission with a condonation fee.
- **Reason for Delay**: In your letter requesting condonation, explain the circumstances that led to the delay, including the principal's refusal to sign Form 112 and any health issues that contributed. Honesty is crucial here; detailing your situation clearly will help ICAI understand your predicament.
- **Consequences of Late Submission**: The primary consequence is the imposition of a condonation fee. Your articleship will not be affected, but it is essential to submit the forms to avoid any issues with your future membership.

2. **Impact on Articleship**:
- **Articleship Impact**: As long as you submit Form 112 and Form 103, your articleship will not be adversely affected by the delay in filing. ICAI typically does not penalize for delays in documentation as long as they are submitted eventually with proper explanations.
- **Delay in Membership**: The delay in submitting Form 112 and Form 103 should not affect your membership. However, delaying the submission might postpone your membership certificate issuance.

3. **Future Consequences**:
- **Job Prospects**: As long as you complete your articleship and pass your exams, the delay in submitting Form 112 should not affect your job prospects. Employers typically focus on your qualification and experience rather than administrative delays.
- **Keeping Silent**: If you conceal the fact of your degree course, it could lead to complications later, especially if discrepancies arise in your records. It's better to address the issue transparently.

4. **Dealing with Non-Supportive Principals**:
- **Future Action**: If you encounter similar issues with other principals, you might consider discussing your concerns with ICAI directly or seeking guidance from a senior member. ICAI often has mechanisms to handle such situations and ensure that students are not unfairly restricted from pursuing education.

5. **Disclosing the B.Com Course After Becoming ACA**:
- **Disclosure**: Disclosing your B.Com degree after becoming a Chartered Accountant should not have negative consequences as long as it was properly documented and you have complied with ICAI requirements.

### Recommended Actions:

1. **Submit Forms**: Submit Form 112 and Form 103 with a detailed letter explaining the delay and any supporting documentation. Pay the necessary condonation fee.

2. **Contact ICAI**: Reach out to ICAI for guidance on any specific issues or if you face further difficulties. They can provide clarity on your situation and assist with any additional steps.

3. **Prepare for Exams**: Continue preparing for your supplementary exams to ensure you complete your B.Com course as planned.

4. **Transparency**: Be transparent about your situation with ICAI and any future employers. Honesty is important for maintaining professional integrity.

If you have any more specific questions or need further assistance, consider consulting a senior CA or contacting ICAI directly for personalized advice.
