Intimation received for short deduction in tds

18 October 2012 Dear Sir/Madam,

I have received an intimation from ITO (TDS)u/s 200A of IT Act 1961. Where it is mentioned that there was a short deduction of Rs. 10450/- & interest thereon Rs.2090/-.

This short Deductions are genuine. Now I have to deposit the respective amount but the proble is this short deduction are under two section i.e

Rs.5450.00 for 194J
Rs.5000.00 for 194C

& interest too

Rs. 1090.00 for 194J
Rs. 1000.00 for 194C

whether I have to deposit two diff. challan.

If yes then Whether I have to give deductee details also in Correction Return.

Please reply in full details.


18 October 2012 Yes. you will have to deposit the said amount in 2 diff challans and details of same needs to given in correction statement.

But the next problem come to me is that i have already shown the amt paid/credited in full in original statement.Explained

Original Statement:

Sec.194J Party - Amt Paid - 104500.00 tds-5000.00
So there is a short deduction of Rs. 5450.00.

But in correction statement whether deductees details will be shown as follows

194J New Challan - Party - AmtPaid/credited- 0 TDS - Rs.5450.00 interest Rs.1090.00

Or,

I have to update old challan the amt. Paid or credited from 104500.00 to Rs. 50000.00 TDS - 5000.00 and

New Challan Amt Paid/ Credited - 54500.00 TDS - 5450.00 Interest Rs. 1090.00.

Please reply how to fill the details.

18 October 2012 U can show in either way. In first case, amount paid/credited as 0 may not be accepted. you will have to show some token amount may be Re.1/-.
