05 September 2013 can we return income tax amt. from govern ment in own account after one year file form -16 waht is proper process please help me

05 September 2013 Your question is not clear; if you don't mine please clearly indicate your case and its facts.

Based on the above i understand as follows.

You have TDS credit for one year back and you asking if any chance to get such TDS refund back and what is the process? is it correct of my understand.

05 September 2013 As per the provisions of the income tax; return of income can be file upto one year from the end of the concern assessment year(i.e upto two years from end of the closing of concern previous year) and can claim refund back if any.

Thus now you can file For A.Y 2012-13 and A.Y 2013-14 income tax returns only.

So if you have such years TDS amount if any then file Income tax return by showing you taxable income and deductions and tax liability and TDS details and claim TDS refund if any after adjustment of tax payable if any.

With out filing of income tax return you can't claim TDS refund etc...

So file income tax return and claim TDS refund.

05 September 2013 if he refund all tds amt what benefit to government & how many amt they refund after one year

05 September 2013 How much credit of TDS you have as per the departments records(i.e as per form 26AS) such whole amount it will refund you. There is no limit to pay refund amount if you filed return of income with in the due date u/s 139(4) i.e time limit as i said above.

If you fail to file and claim TDS refund with in 139(4) due date then the department shall forfeit your TDS amount and doesn't allow you to get refund for a singly rupee also.

05 September 2013 what is timeline to submit refund for whole amt. which after he forefiet whole amt.

05 September 2013 I already told you in my above replies the time limit to file return of income is 2 years from the date of ending of concern financial year i.e for ending 31-3-2011 time limit is 31-3-2013, for ending 31-3-2012 time limit is 31-3-2014, for ending 31-3-2013 time limit is 31-3-2015 and so on.... for past years.

If you not filed your return of income such time limit and not claimed TDS refund then the TDS amount shall be forfeited.

For exams if you have 31-3-2011 year ending or before years TDS then the time limit is 31-3-2013 or before it is already over so you have to forget about such year TDS refund .

So only 31-3-2012 and 31-3-2013 years refund only shall get now.
