Income Tax Department refuse to acknowledge Return

24 June 2009 Hi,
I have filed one of my freinds ITR (F.Y. 2007-08) whose total income was 1.10 Lac only.

I e-filed his return without digital signature, when I go to Income tax department to get acknowledgement they refuse to accept it and saying Income is below 1.50 Lac, the return can not be accepted. I told them that i had already e-filed the return i need just acknowledement of it. but they had not accept my return. and sent me empty hands.

Please tell me what to do in this case.

24 June 2009 They have no power to reject your return. This work is being handled by the peons in the IT deptt. Please talk with ITO.

Can you please advice / guide / provide me any proof so that i can show it to them, that they can not reject to accept the return.


24 June 2009 As told by Tilak, department cannot reject the papers. you are filing your return for the A.Y.2007-2008 for NIL income and they cannot insist you to file with taxable income above exemption limit. You should contact the higher authorities.

24 June 2009 See what TILAK said is right but see i just wanna add one thing that if you have filed your return just take the printout (2 copies) of e-filed return and get the acknowldgement on it if they refuse to give you, then just show the 3rd proviso of section 139(1) and if they further refuse to give you the acknowledgement then simply ask them to refused in writing so that in future anything wrong happnes to you you will have a proof that you had pur your 100% efforts and default was made on part of Deptt.
