30 June 2015 i am salaried employee but not received HRA then whether i can avail benefit of rent paid to landlord and also whether i have to submit PAN card of Landlord. and please also mention why HRA given to employee,

30 June 2015 Yes you can avail deduction under section 80 GG. (a) Conditions for claiming deduction:
1) Deduction under this section is available to individuals. In case of salaried employee, he must not be in receipt of H.R.A.
2) Deduction is available only if rent is actually paid for furnished or unfurnished accommodation.
3) This deduction is not available if any residential accommodation is owned by the assessee or his/her spouse, child, H.U.F. of which assessee is a member at the place where the accommodation is rented. Deduction is also not available if the assessee owns accommodation at any place which he claims as self occupied.
(b) Amount of deduction: Deduction is allowed to the extent of least of the following:
1) Rs.2,000 p.m.
2) 25% of ‘adjusted total income’.
3) Rent paid in excess of 10% of ‘adjusted total income’.
‘Adjusted total income’ means total income before allowing deduction u/s 80 GG and excluding incomes from which no deductions is allowed under chapter VI A, i.e. casual income, short-term capital gain taxable @ 15% and long-term capital gain.
