HRA Exemption

27 July 2010 Hi,

My query is as follow:

Employee A lives in Delhi, working with a company based in Noida. A forgot to disclose the fact that he is living in metro city & his employer made HRA calculations on the basis of non metro city i.e., 40% of Basic salary & deducted TDS accordingly. Now employer says it was employee fault, books of account for fy 2009-10 has also been closed & TDS has been submitted to respective dept., no benefit can be provided. Can we claim such TDS on the ground that calculations should have been made @ 50% of basic salary. Original return is to be filed on or before 31-07-2010. Kindly explain the procedure and send it to sankalpkohli@gmail.com.

27 July 2010 i think 50% percent can be claimed... but my advise would be to file itr2 where detailed calculation for salary computation.

based on tat HRA benefit can be claimed and refund can be applied. very true and genuine case

27 July 2010 Mr. A can re-calculate his HRA & claim additional exemption in ITR & apply for refund.

27 July 2010 dont worry friend,
Mr. A can claimed upto 50% from ITR-2 as per suggested by expert,
whatever done by your employer is not affect to you bcs you can claim whatever your employer has not taken earlier in Form 16.
there are Many cases of after deducting extra tax by employer and by filling IT Return employee are receiving refund which was excess deducted by employee.
so cheerup dont worry.
