Good Afternoon Experts, I am having a query regarding the refund of the TDS My friend has worked under the contract in one office, they had deducted the TDS for him for the two years (2006-07 & 2007-08) but he hadn’t claimed the refund (amount around Rs.2800 & Rs.1100) ,as he don’t know about that provisions, and he had applied for the PAN at that time.
Now he is having the Form 16A with him, which shows the amount deducted for the past years.
Now he is getting less stipend and He doesn’t have any other income in the past as well as now.
Here the Question is 1. Is the refund provision available now or removed? 2. Can he claim the refund now, of the same which was deducted in the past previous years? 3. If we can claim, Please tell the procedures to be followed; a. How to take the steps of refund. b. Which form has to be filled? c. What are the necessary documents to be provided, if any?

In order to get the refund, First & foremost Income tax return should have been filed within the time allowed U/s 139. Since the refund is pertaining to Financial years 2006-07 & 07-08, the due dates for filing the returns was 31.07.2007 & 31.07.2008 respectively.
The maximum time permissible for filing the return of income is one year from the end of relevent assessment year i,e. If the F.Y.06-07, then A.Y.07-08 31.03.2009 is the last date for filing the return or assesement is complete.
