Gratuity is payable to a person who is in continious service of 5 years with the company.. hence i am of the opinion that when a employee is offered a job and ctc is prepared,, gratuity shall not form part of ctc for such years,,

If it is not the part of the CTC then whate ver premium paid by the employer to maintain grautity fund how it will be treated ? wheater it will be expenses for the company if yes then it should be over & above the CTC ?

Yes a gratuity fund may be created.. and may be accounted separately.. it shall be over and above gratuity.. again there are companies who would allocate the same and treat it as a part of CTC,, i am of the opinion that the same be expensed off..
