Gratuity claim

06 December 2012 I have completed 4 Years and 6 Month of Service and got relieved from the company.

I have made claim of Gratuity, but the company is denying to pay the same as they are saying that I have not completed 5 years of service.

But I have seen in the Act that every 6 months of completion of services is deemed to be the complete year of service.

Pls. Suggest and Give me the way out.

For reckoning first 5 yrs it is 4 yrs & 240 days..

So you cannot claim gratuity legally.
