Sub: Direction issued by the Central Government
under Section 54 of the MPT Act, 1963 to
modify the existing demurrage charges/
licence fee for storage facilities of finished
Sugar and Pulses at the Major Ports and
TAMP's Order No.TAMP/29/2009-Misc.
dated 22.9.2009.

Ref: Circular No.TM/D/4-3/19 of 1996-97
dated 28th August 2009.

By this office circular dated 28.8.2009, Port users were informed about the Tariff Authority for Major Ports order No.TAMP/29/2009-Misc. dated 25.8.2009, on amended demurrage charges/licence fee in respect of Sugar and Pulses.




2. Now, the Govt. of India in the Ministry of Shipping vide its Order No.PT-11033/46/2009-PT dated 17.9.2009 has issued an order in public interest in supersession of its earlier order dated 21.8.2009 for levy of demurrage charges/licence fee in respect of Sugar and Pulses under Section 54 of the MPT Act, 1963.

3. Accordingly, TAMP vide order No.TAMP/29/2009-Misc.dated 22.9.2009, has amended the demurrage charges/licence fee in respect of Finished Sugar and Pulses as per the schedule given below:

Sr.No. Description Charges
1. Finished Sugar and Pulses (Import)
(i) Free period As applicable in the Port.
(ii)
After free period upto 21 days (incl. Free period) As applicable in the Port.
(iii) Beyond 21 days Four times the rate applicable in the port.

NOTE:
• Free period excludes Customs holiday and port's non-working days.
• Free period shall commence from the date of completion of unloading.
• These rates shall not apply to Yellow Peas and Raw Sugar, which will be regulated as per the applicable rates in ports prior to 25.8.2009.

4. The TAMP's order dated 22.9.2009 will be implemented in the following manner:

(a) Demurrage on Import consignments of Finished Sugar (excluding Raw Sugar) and Pulses (excluding Yellow Peas) :

(i) Storage of non-containerized Import consignments of Finished Sugar (excluding Raw Sugar) and Pulses (excluding Yellow Peas) will be allowed in Docks free of demurrage for six calendar days following the date of vessel completing discharge operations. On expiry of free days, demurrage will be charged for the period of storage on Finished Sugar (excluding Raw Sugar) and Pulses (excluding Yellow Peas) remaining uncleared, at the following rates:

(ii) Storage of containerized Import consignments of Finished Sugar (excluding Raw Sugar) and Pulses (excluding Yellow Peas) will be allowed in Docks free of demurrage for ten calendar days following the date of vessel completing discharge operations. On expiry of free days, demurrage will be charged for the period of storage on Finished Sugar (excluding Raw Sugar) and Pulses (excluding Yellow Peas) remaining uncleared, at the following rates:

(b) Licence(storage) Fees on Import consignments of Finished Sugar (excluding Raw Sugar) & Pulses (excluding Yellow Peas) stored in the specified areas of Port :

The Licence (Storage) Fees on storage of Finished sugar (excluding Raw Sugar) and Pulses (excluding Yellow Peas) will be recovered at following rates:

Note :The cargoes lying uncleared beyond 180 days shall be subjected to demurrage from the 181st day onwards as per following rates. For the purpose of levy of demurrage the 181st day of storage of cargo will be treated as day number one.

5. The amended demurrage charges/licence fee in respect of Import consignments of Finished Sugar (excluding Raw Sugar) and Pulses (excluding Yellow Peas) have come into effect from 23.9.2009, i.e. the date of Notification in the Gazette of India, Extraordinary, and shall remain in force till 31.03.2010 or until further orders.

02 November 2010 Ya its not in specific to sugar / pulses..but in general let us say for capital goods..etc

03 November 2010 dear Subramanyam ji, i am sorry i could not see your query of 30th october wherein you had clarified that it is for capital goods. then there might not be any free storage period. you may have to pay demurrage charges if there is delay in clearance of goods.
