29 May 2013 From the payments that companies have made to me, they have deducted a sum as TDS. It becomes very difficult to get the form 16A from them. (They are behaving as though they are doing some favour to me.) Is there any way, I can generate them myself, or I can get them easily?

29 May 2013 Form 16a is to be provided Within fifteen days from the due date for furnishing the statement of tax deducted at source under rule 31A.

So wait till some time atleast i.e,31st may 2013 as duedate to furnish Q4 tds return was 15 May 2013

Q.What can I do if I am unable to get the TDS certificate (Form 16 / 16A)?

It is the duty of every person deducting tax to issue a TDS certificate. In spite of your request, if you are denied the certificate then there is a chance that the tax deducted has not been deposited by the deductor to the government account. Please inform the department (PRO or TDS section) which will then do the needful.

29 May 2013 Before that please check your 26AS afer login to www.incometaxindiaefiling.gov.in

if tax credit is shown for all amount deducted by your deductor you can file tds return basing on this and can file your income tax return basing form 26as and you can collect tds certificates later

However please ensure that total amount deducted from you is properly shown in tds return.and also collect form 16a for your future corresondence with departement.


15 July 2013 You can download from NSDL site by giving the TAN number and do not worry you can download the TDS from AS 26 and accordingly you can file your return by claiming the TDS appearing in AS 26

Some companies have deducted the amount from my payment, but it is not reflecting in 26 AS (I think, it means, they haven't deposited the amounts with the govt.)Whta is the fate of this? Can it be used for the next year return?

15 July 2013 Yes, you have all right to ask form 16A from deductors...

generally as per Rule 31AB deductor required to submit form 16a with in 15 days from the duedate of tds return

So just ask deductor to provide form 16A if deductor fails to provide you form 16A demand the money deducted from you back
