Form 16 with tax payable

19 December 2012 Can an employer issue a form 16 with balance tax payable to an employee? This has happened by an employee who had not fulfilled to submit his self-declared proof.

Please reply and any implication on the employer part will be levied?

19 December 2012 no, its not employers faulty, employee is in fault.

19 December 2012 Yes you can issue form 16 which shows tax payble. It is employee's responsibility to deposit the remaining tax through self assessment challan. You are not at all at fault.
