I have received an assessment order u/s 143(3) for A.Y.2008-09 disallowing expenditures namely Motor car, Telephone & Travelling for 20%. the reason that it can't be decided that whether it is of personal nature or not.
However, FBT has alrady paid on such expenditure.
Whether A.O. is correct in disallowing such 20% of the expenditure???
Please Reply as soon as possible....
Also mention cases supporting your advice.

ASHISH WHEREAS FBT ALREDY PAID ON SUCH TYPE OF EXPENDITURE. SO THERE IS NO NEED FOR CANCELLATION.
