Exice on sale of scrap or wastage

02 December 2011 1)Whether excise is leviable on sale of scrap or wastage by an unit which is registered under Central Excise Act?
Suppose a garment manufacturing unit registered under excise sells the yarn wastage or cloth wastage, whether the firm has to pay the excise duty on said sale.

2)will there be any difference if the yarn or cloth was purchased from non excise unit?

03 December 2011 for the purpose of levieng Excise Duty it is necessary that the goods must be Marketabe and have some commercial existence, merely b'coz it can sold .......not make them exciseable....

04 December 2011 I want to know there is any tariff head under which wastage of cloth & yarn is excisable.

15 December 2011 whether wastage generated during the garment manufacturing is excisable, if the firm is registered under chapter heading 61 & input are knitted cloth and yarn?
