The provisions state immediately. However as per the decision of the SC in the case of Formica India division, benefits available under law cannot be restricted when there is a duty demand. Ideaaly - within 1 years not dispute 1-3 years - some dispute possible but within limitation act ( to what extent that is applicable not knwon) Over taht - disputable though support of case laws exust.
