What is legal position in case if one deducted TDS at normal rate & later party give certificate for lower rate & caliming refund of excess tax deducted in earlier months.

Hi, Lower tax rate deduction certificate has to be submitted with deductor before deduction of tax. As no such certificate has been produced therefore excess tax deducted in earlier months can not be refunded. The deductee has to file return of income and can claim refund of excess tds.
