30 November 2011 helo,
tell me that if an employees salary is 16000 p.m and he is getting 13000 due to his holidays.. now tell me whether esi is applicable or not.

30 November 2011 ESI act applicable to those employees who withdrawn salary not exceeding Rs. 10000 per month.

in your case ESi act will not applicable because employee withdraw salary more than 10000 per month

30 November 2011 from 01/05/2010 limit of ESI increased from 10000/- to 15000/-.thats why m asking?


30 November 2011 Sorrry preeti for inconvience....because ESi applicable on the basis of basic salary...if in this case salary per month is 16000 then ESI act shall not be applicable..because it is irrelevant he get salary less than 15000 due to holiday

Notification – New Delhi, 20th April, 2010

G.S.R. (E)- The following draft rules further to amend the Employees’ State Insurance (Central) Rules, 1950 were published as required under sub-section(1) of section 95 of the Employees’ State Insurance Act, 1948 (34 of 1948) in the notification of the Government of Indian in the Ministry of Labour & Employment vide No. G.S.R.164 (E), dated the 26th February, 2010, in the Gazette of India, Part II, Section 3, Sub-section (i), dated 27th February, 2010 for inviting objections and suggestions from all persons likely to be affected thereby till the expiry of the period of thirty days from the date on which the copies of the Gazette of India in which the said notification was published, were made available to the public;

And whereas the copies of the said Gazette were made available to the public on 27th February, 2010;

And whereas, objections and suggestions received from persons likely to be affected thereby have been considered by the Government;

Now, therefore, in exercise of powers conferred by section 95 of the Employees’ State Insurance Act, 1948, the Central Government, after consultation with Employees’ State Insurance Corporation, hereby makes the following rules further to amend the Employees’ State Insurance (Central) Rules, 1950, namely:?
These Rules may be called the Employees’ State Insurance (Central) Amendment Rules, 2010.
These shall come into force from the 1st day of May, 2010.
In the Employees’ State Insurance (Central) Rules, 1950, in Rule 50, for the words “ten thousand”, wherever they occur, the words “fifteen thousand” shall be substituted.

tell me one more thing that if basic salary is below 15000 and he is getting 13000 due to holidays then calculation of esi should be on 13000/- or 15000/-?


And another doubt is that if salary of an employee is above 6500/- like its 15000/- and he is getting 13000 due to holidays now calculation of epf should be on 6500 or it should be on 6500/15000*13000..one of our doing the calculation on this basis

01 December 2011 1.ESI is calculated on employees GROSS salary its also includes Incentives & NFH (National Festival Holidays & other Allowanes

Both Employer ( 4.75%) & Employee (1.75%) Must contribute ESI Pay on Employee Gross Salary

2. in order to know the gross salary, you will have to deduct esi, and pf (Employers share) from C.T.C or anyother such component which does not form the part of routine salary, like bonus, etc.

then after you can make the calcualtion for E.S.I .
