13 January 2014 hi..sir Is there any case that, employee 's contribution under ESI can be more than 263 i.e 15000*1.75% and also is there any age limit in contribution to ESI ? please explain it

Yes, if you pay variable pay i.e. Incentives or any Other allowance on month on month basis then it also forms part of salary & ESI is also need to be contributed on the same.

If such payment is made every month then your esi wage restated and esi may not be contributed.

15 January 2014 thank u..sir got it.and if its the case where fixed gross salary is more than 15000 and if the actual gross salary is less than 15000 then ESI need to be deducted for that particular month?

15 January 2014 No, it is not like that. If fixed gross salary is 15K then no esi applicable!

As per circular 5/2002, if hotel room is occupied on regular basis, then the tds should be deducted u/s 194I, so if it is not regularly occupied, there is no tds u/s 194 I but subject to TDS u/s 194C.
