07 January 2011 Is education cess applicable on the Payments made to Non Residents,when there is a flat rate (say10%) defined by the treaty (DTAA)??
i mean is the rate of 10%(say) to be increased by Ecess or not?

As per the DTAA regulations there is no need to to deduct Education cess @ 3% on payment made to non residents
