SIR I WANTED TO ASK WHETHER EXCISE DUTY IS TO BE PAID BY AN EXPORT ORIENTED UNIT ON DOMESTIC TARIFF AREA SALE OR NOT. THE UNDERTAKING IS ENGAGED IN EXPORT OF SOFTWARE SERVICES AND REGISTERED WITH STPI AND IS HAVING A DTA SALE ENTITLEMENT FROM CENTRAL EXCISE

If the product is an excisable goods the CED is payable and if the same is ataxable service servic etax is payable inspite of it being an EOU.
