Can a legal representative sign with his digital signature for his deceased person? If yes what will the process as in case DSC will be taken in the name of Legal representative and ITR will have the PAN of Deceased person then there will be mismatch of PAN Number's and system will give an error at the time of efilling and registration of DSC.
Pls help in getting the complete process for the same i.e. in who's name and with who's PAN DSC need to be created and used?
First of all, While signing with DSC the physical presence is not at all required. Thus the deceased person can sign his ITR with the help of DSC with his own PAN.
If he likes to authorise a legal representative, then the DSC should be in the name of the authorised person and the PAN also encrypted in the DSC is authorised person's PAN.
When uploading the ITR, make sure that the PAN of Authorised person is entered in the verification column of XML. This will enable to easily upload the ITR without any error.
