Difference between charitable trust and charitable society

18 June 2017 Our church, basically a Syrian Jacobite church, want to start an educational institution. The administrative powers of the church rest with the general council, where all male members of the church are members.The general council meets once in a year and elects the managing committee, which runs the church for an year. So we would like to know that, is it better to form a charitable society under the church to run the proposed educational institution or should we form a charitable trust to run it. Looking for an advise...please..


18 June 2017 Trusts are registered under Indian Trusts Act, 1882 while Societies are incorporated under the Indian Societies Act, 1860.


Minimum number of members Two in trust Seven in societies

Winding-up Trust is generally irrevocable, Can not be wound-up. Can be wound up if 3/5th of the members so desire

Governed by Board of Trustees Governing Body in society

Main documents Trust Deed Memorandum Of Association Rules and Regulation


Objectives in trust Can be general but in society Have to be specific

In trust Family members Can become trustees but in society Registrar objects on family members becoming part of the Governing Body
