22 September 2012 suppose TDS is deducted for AY 2012-13 but not deposited by deductor , whether to claim TDS in the return or wait untill it is reflected in 26AS in the years to come and claim in that year...

if deductor doesn't deposit inspite of repetitive reminders?

22 September 2012 TDS credit cannot be taken untill the 26AS showing the details.

ask the deductor to deposit the TDS. that is responsibility of deductor

22 September 2012 Once the tds is deducted, it is a tax paid on the part of assessee. Assessee can very well claim such TDS as tax paid. Also refund can be claimed. But be safe on your side and obtain a tds certificate from the deductor. AO will penalize the deductor for not depositing the tds deducted.
