28 October 2011 A Government company cannot claim any deduction under section 10A, 10AA and 10B –

(a)True
(b)False
(c)None of the above
(d)True in some cases.

I don't understand the exceptions in tax law in relation to government companies if there are any. Please help with the above question.

29 October 2011 The Ans for the above question is False.

As per Section 10A - it says ANY UNDERTAKING located in SEZ FTZ or EHTP and carrying out the manufacturing activity. Hence any undertaking covers government company also.

As per Section 10AA - it says entrepreneurs located in SEZ and carrying manufacturing activity. Hence Govt Com Covered.

As per Section 10B - 100% export oriented undertaking with the approval of central government. Hence here also govt com is covered if the condition is satisfied.

there is no any exception that govt com cannot claim the exemption.
