One of the my friends imported goods from Outside in India and then , he assembling and then get finished product .finally he sale the goods in local. Now my question is above assembling come to in CENTRAL EXCISE

ASSEMBLY PROCESS AMOUNTS TO MANUFACTURE IF-- 1] AFTER ASSEMBLY NEW PRODUCT COMES INTO EXISTENCE HAVING DIFFERENT CHARACTER,NAME AND USE.
2] ORIGINAL PRODUCT DOESNOT SERVE SAME PURPOSE.
IF THE ABOVE CONDITION IS SATISFIED THEN IT AMOUNTS TO MANUFACTURE AND EXCISE DUTY IS LEVIABLE.
