Change of Jurisdiction

08 June 2009 My company changed its head office from Mumbai to New Delhi wef 01.07.08 and subsequently obtained a new TAN for delhi office. Earlier TDS of salary was being deducted from Mumbai TAN but once HO was changed delhi started deducting TDS & filing returns.
How will we issue TDS certificates for salary for the FY 08-09. Can we issue 2 certificates or only 1 should be issued mentioning both TANs. Please advise.

08 June 2009 changing head office address does not required to take new pan/tan. You just need to change the address in PAN/TAN data by submitting the change in address form to NSDL.

You can take new tan if the name of company changed. In your case you need to surrender the one TAN to income tax department.

Still i advice you to check this with your company auditor.

08 June 2009 In my opinion if you have obtained 2 TAN then you will have to issue 2 TDS certificates. Obtaining 2 TAN was not at all required. But if 2 TANs are obtained and the payment is made from 2 TANs then you will have to issue 2 TDS certificates.


08 June 2009 It is illegal to possess or use more than one TAN it also attracts a penalty of Rs. 10,000.

The other TAN/s should be surrendered for cancellation using 'Form for Changes or Correction in TAN' which can be downloaded from NSDL-TIN website or may be procured from TIN-FCs or other vendors.

09 June 2009 for branch you can take tan but change head office address does not mean of branch setup.

Hence you need not have to apply for additioanl TAN.

in duplicate PAN, question 1. It clearly says that it is an offence to have more than one TAN no. at a time. And when you quote this TAN for makeing tds payment that means you have quoted wrong TAN in challan which attracts penalty of Rs. 10000.
