Non filing of the return in due time is applicable penalty,but for filing of nill return not applicable penalty,because of there is chances to haven't any transactions for a particular period, but if it proved you wrongly and intentionally filled nill return to avoid tax payment even though you have transactions then penalty shall levy by the department at the time of find out by them.
