Can two LTA be claimed in one year of the block.

This query is : Resolved

24 November 2009 The current block is 2006-09. Suppose Mr X an employee had undertaken a journey in the month of February 2009 and again he had made journey say in November 09 i.e two journeys in the same calender year but two different financial years. Assume, he had not claimed any LTA exemption from 2006 to 2008. For the finiancial year 2009-10, can he claim the two benefits on the basis of calender year of the current block? In other words, can he claim two exemption in a finiancial year though journey undertaken in two financial years but within the same calender year. Pls. let me have your expert views.

24 November 2009 Yes it is available. It can be used 2 times in a block of 4 years. If not used in the preceeding 3 years it is available

24 November 2009 No the concept of calendar year is for counting the no of LTC, however exemption should be claimed in respective years only. For journey performed between 1 april 2008 to 31 march 2009, relevant previous year is 2008-09 and assessment year is 2009-10.

24 November 2009 Yes, he can claim

24 November 2009 Manmohon, Rule 2B no where stated that it would only be claimed only in the year of journey, but so far as my understanding the block year of 4 years consist as one unit applicable separately for each financial year starting from 2006-07 to 2009-10. Thus, if he submit the documents in 2009-10, he may claim. Please correct me if i am wrong.

24 November 2009 Yes he can claim
