According to me you can charge the vat at the rate applicable in case of local sale.

if C form is not received by you than you have to pay the local VAT - CST 2% = difference amount which will be payable...to your state sales tax office...
so, its strictly to first confirm the party for issuing of C form otherwise you charge local tax to that party if the are not able or whatever reasion issue C form..
after sale received C form in time or pay difference tax ....
