12 November 2013 Please I need a help on this matter."date of joining new firm should not be more than the difference between the date when your 2.5 years is completing and first day of month of relevant attempt" is this mentioned in any ca regulations? I have joined my articleship on 29-April-2013, and my attempt falls after 2.5 yrs in november 2015, does that means i have only 2 days for getting registered in new firms if i take transfer??

12 November 2013 ICAI Directly not mentioned it, but technically it is correct and indirectly mentioned.

For your doubt the clarification is as below.

As per the ICAI regulations those who Completed their IPCC/PCC/Interemediate and who are under going of last six months of articleship training including excess leaves if any as on first day of the exams commencing month(Means completion of 2.5 years of articleship training2.5 years assuming you didn't have excess leaves) and have valid registration of CA Final are eligible for CA Final exams.

The ICAI shall consider the period between date of termination and date of re-joining into articleship as break in articleship period not the leave.

What is the difference between Break in articleship period and leave to articleship period,

The leave period shall be counted for the purpose of articleship training period and at final computes the eligible leaves and excess leaves but Break in articleship period shall not considered as articleship training period. So ICAI suggesting all those who terminated their articleship complete their re-articleship registration as early as possible for not to delay of CA Final attempt.

Still if you have any confusion i will provide you example, so you required example please reply here.

12 November 2013 Could you give me my own example please?...assuming excess leave is 0 days..

13 November 2013 As per the date of commencement of your articleship is 29-4-2013 you are eligible for November'2015 CA Final attempt assuming you didn't have any excess leaves.

From the date of commencement of articleship till 31-10-2015 you shall complete your 2 years 6 months and two days of your articleship training means as on 1-11-2015 you have balance period of articleship of 5 months 28 days means pursuing last six months of articleship training. You didn't have any excess leaves so you are eligible for November 2015 CA Final attempt.

In case assuming you have taken termination from your articleship on 31-05-2013 and rejoined into your articleship from 5-6-2013 means after four days from the date of termination(gap of 4 days means you didn't have articleship training for such 4 days it shall considered as break in articleship training) then on 31-10-2015 you shall complete only 2 years 5 months and 28 days of articleship training only means on 1-11-2015 you have balance of articleship training 6 months 2 days means as on 1-11-2015 you are not pursuing the last six months of articleship training.

As first i said means you didn't have any termination or gap between termination or re-join then by 31-10-2015 your articleship period shall complete 2 years 6 months and 2 days as per ICAI regulations has required to complete 2 years 6 months as on 1-11-2015 to get final attempt eligibility, thus you have 2 days grace to re-join into your articleship after termination with out extension of eligible attempt of CA Final.

Hope you understand and clarified your doubt, i otherwise please provide i shall provide you more detailed explanation.

26 December 2013 Sir,Recently I got a termination letter from ICAI, and it included an excess leave of 11 days. Does the excess leave has an effect on my final attempt??

30 December 2013 Its depending on the leaves taken and excess days worked at the new employer.
