11 September 2013 Sir, currently I am in the first year of my articleship. I cleared my ipce in november 2012 and had registered for my articleship in february 2013 (last date being 30th april 2013) and my finals is due in november 2015. Due to certain reasons I have applied for transfer of articleship. The problem is that my principal has sent me on a leave for 25 days and as per his words, he will sign 109 form on 1st october 2013. I have already taken considerable amount of leaves till date for various reasons. Now my query is, if my former principal shows excess leaves in form 109 say for 70 to 80 leaves, can it delay my final exams by 6 months which is presently due in november 2015. Also if I dont take any leave in the rest of my articleship period, will that help in improving the situation. Seeking your advice. Any help would be greatly appreciated. Thanks.

11 September 2013 Yes, your article ship period will extended by 3 years + excess leave.

And if your excess leave is extended after 01/11/2015, then you will be eligible for May 2016.

12 September 2013 If you had taken excess leave you have to serve such period as an article before writing your finals...

At least 2.5 years of artileship is required to write final examination as know..

12 September 2013 There are 2 options or rather rules.

1) If there is any break in completion and serving of excess leaves or change in principal u need to execute deed in form 102 and Form 103 for the excess leaves and form 108 for period already served.

2) if there is no break nor change in principal the execute deed in form 107 and file form 108 for period already served.

12 September 2013 Those are the two basic forms which I will have to fill again while registering the articleship under the new Principal. That is ok. I got it. So according to u, 2.5 years have to be served. Which means a person resgistering for articleship on say 30th april I.e. the last day of registration is not entitled to take any leave? Is that what meant? Because if he takes, he will not be eligible to appear in november 2015. There has to be some relief provided by ICAI to the students.
