17 December 2013 Can 3 month gap between date of commencement of article ship and date of deed execution is acctable?

17 December 2013 Yes, you can execute and submit the same.

DELAYED SUBMISSION OF FORM NO. 103
In case Form No.103 is not submitted to the Institute’s Office within 30 days from the date of commencement of training, the procedure laid down by the Council for condonation of delay in submission of forms will apply. Delay fees to be paid 30 days beyond specified period Rs. 100.
31–180 days beyond specified period Rs. 300
Beyond 181 days Rs. 1000
Either of the following records may also be sent (if the delay is more than 181 days):
a. Attendance record of the Articled Assistant.
b. Original deed of Articles in Form 102, executed on non-judicial stamp paper.
c. Certified copy of the work diary of the articled assistant.
d. Stipend details with evidence in the form of Bank Pass Book/Statement.

17 December 2013 No, ICAI will not accept that it may be reject, However there is appropriate reason and it is reasonable cause to delay and you have full evidence for completed period of articleship training really undergone by you, then it may consider and accept.

So generally it not accept.

17 December 2013 @Ajay Mishra sir, I think the author asking about the date of deed execution means form 102 agreed date not for the submission of form 103 delay.

In one of the case i saw ICAI rejected those who agreed form 102 after one month from the date of commencement of articleship(stamping(franking) of form 102 also on the same date of deed executed) is rejected by the ICAI.
So i requesting you, please clarify me.

17 December 2013 sir i have current date stamp paper but form 102 fill form commencement of date of article ship and i have some mail as an evidence of my work or nothing else.

17 December 2013 Dear Dintakurthi.....

Kindly confirm that if i have purchased non judicial stamp paper on date of commencement of article ship and executed this stamp paper after 2 months after coming of my principal in to place of my work and then I will submit the documents with Form-103 with Institute sayong that principal was not available in town from last 2 months then Institute will reject my registration application or not.

Kindly confirm, I am not aware of the validity of Form-102.

17 December 2013 If you have current stamp paper then you can not use it for back date of article ship deed.

17 December 2013 In the case you said the ICAI Will not reject, i also accept you for your case, but here the case is reverse the author purchased stamp paper today but actually date of commencement of articleship is 3 months before. But in your case date of purchase of stamp paper and commencement of articleship is before 3 or 2 months but form 102 & 103 submitting now. So please observe the difference i am not controversy to you. The case regarding delay in stamping and execution of deed not for the submission of form 102 & 103.

17 December 2013 In such case ICAI shall accept your form and you may not face any problem from the side of ICAI, but you shall be loose your past 3 months of articleship period as your service period and your articleship training period shall be count from now to next 3 years.
