03 August 2012 SIR WE(PVT LTD COMPANY) ARE PAYING AMT TO A PERSON WHO IS A RESIDENT OF PAKISTAN AND WE ARE REQUESTING YOU TO GIVE ME CLARITY REGARDING WHETHER WE HAVE TO DO TDS ON THE PAYMENTS MADE TO HIM

03 August 2012 Mr. Hari liability to deduct TDS from payment to Non resident depends on the nature of payment..

As per section 195 only those nature of payment which are chargeable under the provisions of Income Tax Act then only it would be required to deduct TDS under section 195 from the amount of payment...

04 August 2012 HERE WE ARE PAYING COMMISSION TO THE NON-RESIDENT WHO IS A RESIDENT OF PAKISTAN. WE ARE THE COMPANY IS PAYING THE AMT TO HIM. WHETHER WE ARE LIABLE TO DEDUCT TDS U/S 195 OR NOT PLEASE GIVE ME CLARITY
