A.G.M date for company

26 December 2009 sir,
If company is incorporate on 22-11-2007.Is it requires to file two annual returns i.e for (2007-08 & 2008-09). Or it req to file only one annual return? If it req two returns what is the due date for A.G.M's?

26 December 2009 The due date of agm is subject to following conditions :-

Condition 1 :-
Within 6 months of closing of the Financial year of the Company

Condition 2 :-
Every Calender year one AGM should be conducted

Condition 3 :-
The time gap between each agm shall not exceed 15 months. (18 months in case of First AGM from the date of incorporation)


26 December 2009 mr saikiran, i think there is something wrong in your question, incorporation date is 22-11-2009, then your 1st AGM will be held on or before 30.09.2010, but not in 2007-08 & 2008-09.


28 December 2009 when sec.210 & sec.166 applied the A.G.M should held at with in 6 months from the end of financial year acc to s.210 & if it is first A.G.M it should held with in 18 months from the date incorporation according to s.166. In that case the A.G.M is held for financial year 2007-08 is at 31.12.2008 or will held at 30.09.2010 please clarify me?

28 December 2009 for First AGM will be held of earliest date as per Sec 166 & 210 i.e. if ur incorporation dt is 22-11-2009
As per Sec 166 AGM can be held uptill 21-5-2011(upto 18 months from incorp. for 1st AGM)
As per Sec 210 AGM can be held uptill 9 months from end of Financial year so if ur financial year ends on march 2010 u have to held AGM uptill 22-12-2010

So of above, earliest date is 22-12-2010 hence u have to held before or on 22-12-2009
