My , Mother 63 years is suffering from Parkinson since more than 5 years now till date, My Father is retired more than 8 years now, was a Canara Bank employee and getting Pension But does not come under TAX bracket.and neither we have claimed any tax benifit/Claims towards her medical expenses till date. So Can I claim the Maintainence and treamtment expensese for my Mother under these sections? Since I was unaware of this deductions before can I Claim revised returns for the last 3-4 years too? Please guide-Anil Kamat

Thanks for you answer mr Dinesh Adhikari, Could you please reply 1) if i need to support the bills too with the revised returns 2) Since my father is a pensionee and as told he is not taxable, I being her eldest son I can claim these for 2008-09 and 2009-10.right? Regards-Anil

As per present rules of Income Tax, you do not need to attach anything with ITR but should be present before IT officers if required by them.
Claim depends that whether you father if fully dependent on you or not. If he is fully dependent on you, only then you can claim but if he is even partially dependent on you then you would not be able to claim this deduction as per 80DDB.

Dear Mr Dinesh Adhikari, Thanks for the reply 1) My Father is not suffereing from parkinsions, its my Mother, But my father darws pension, My mother is house wife and dependent on me and my father too , But my father is not a tax payee and neither hass any insure claims etc on my mother, So I bear her major medical expenses 2) Is this very necessary a gorvenment doctor must certify this, as her treatment is now with a well know neorouligist,MD, - or its necessary to still show the reports to government doctor and get the dignisis confirmed above 40% or not? please clarify.. Dear Mr. Anil, Sorry for my mistake,
1) You can claim that Mother is mainly dependent on you.
2) About the Govt. Hospital following passage is given under this section:Government hospital” includes a departmental dispensary whether full-time or part-time established and run by a Department of the Government for the medical attendance and treatment of a class or classes of Government servants and members of their families, a hospital maintained by a local authority and any other hospital with which arrangements have been made by the Government for the treatment of Government servants;. Therefore you would have to take certificate from any govt. hospital.
and please note there is not any issue of 40% like 80DD, only diesease should be there and expenses should have been made on that diesease.
