This query is : Resolved

19 June 2015 Sir,
my brother is spending his money for the purpose of education to me (final coaching) and my uncles(my fathers own brother)can my brother canis eligible cliam deduction u/s 80c of such above mentioned expense??

19 June 2015 No, your brother is not eligible to claim deduction.
This deduction in respect of school fees is covered under Section 80C of the I-T Act. A parent can claim a deduction of payment made for tuition fee to any university, college, school or any other educational institution.
Even if assessee has paid tuition fees for his own studies, he will not be eligible for deduction.

19 June 2015 but there is a provision that even illigal or adopted child edu.exp can be claimed?

19 June 2015 Yes this provision is there. In my opinion unless otherwise legal paperwork is done, this deduction cannot be claimed.

If you want to claim; you can claim deduction; but if AO demands for proof then you must provide legal documents for adoption of child
