1. Yes, it can hold 1st AGM in Nov 2009.
2. Yes, from Sec 210, it is inferred that accounts for 1st AGM should relate to period beginning from inc to that date interval between which and date of AGM shall not exceed 9 months. and for subsequent AGM this period is 6 months. It means it should be signed before AGM. So in your case if inc is on 18-9-2008 and if FY ends on 31-3-09 then AGM should be held before 31-12-09 and B/S should be signed before AGM.
3. Notice of AGM contains B/s, P&L A/c, Audit Report and Director's report. Hence, if these are not signed, then you can not give it as attachment to notice. You have to issue notice without attaching B/s and other attachments.
