I was a bit confused about legality & validity of notification issued by ICAI on 27.03.09 in regard to students. Whether Institute has these many powers under any law that it can even bound an article (a major person i.e. above 18 yrs. – As per constitution) to undergo article in a city in which his parents are working & whether institute has power to decide even the place of livelihood of an article. I am a bit confused that if an article’s parents are living in a distant village & there is no CA firm within a diameter of 50 km or even if there is any firm it doesn’t have vacancy, what will happen in such cases.

The notification has been brought with a social cause. Institute is having super seniors who bring out notification with great care and caution for the benefit of the student community.
If you really face a problem of not finding a firm with the reason and proper details you can write to the insitute and if it is fit case they will agree to undergo training at a different place.

But its really difficult for students to follow the rules. specially regarding transfers.
There are lots of students who used to go to city otherthan their home town just for the sake of Coaching at a good place and most of them do articleship regularly and not that one called DUMMY. They do get a medium firm from where they can get a work exp. and also get the classes at a good place. and when thier coaching will be over they take transfer and come back to hometown .
In such a case what they will be doing after such a rule of ICAI.I think ICAI has not thought about this.They are putting stress on just Practical Training. If they really want a good Training then they should keep the traning compulsory after examination of exam should be after 1 yr or say 6 months after the completion of training.
Another onen i feel is Regarding members.
ICAI knows that there are lots of places where articles are required to work for more than the time spcified by the ICAI. but it has never taken any action against such firms or CAs which has tobe taken.
I really feel RUles should be liberal as regard to transfer.
I agree with the rules of Coaching but totally unsatisfied wiht Transfer ruls.
