03 December 2012 As a service tax recipient we are deduction 50% of service tax amount from contractor bill and deposit the same to central government account, when provider is registered under service tax. If provider is unregistered than we are withholding the his part of service tax. Now my question is the withheld amount retain the books or shall deposit in govt account

For the service receiver it is immaterial that the service provider is a registered or unregistered.,
U have to pay service tax on the service portion of the work contract @50% of the service tax.
if the service provider is registered or un registered u will be liable to deposit the 50% of the tax in the Govt...

thank u sir for your expert comment, further i want to know what will be the answer when Contract is "Inclusive of Tax" or "Exclusive of Tax"

Further there in any change, if we have withhold entire contract amount because of service provider is unregistered

04 December 2012 After CBEC circular no.165 dated 20.11.12, fees paid to director in which payment code no. we will deposit.
