Urgent-tds refund to deductor

20 September 2014 Hi All,
I have a very specific query related to TDS refund.
1.How can a deductor claim refund of TDS if it was deducted on excess amount say Rs 100 instead of Rs. 70.
2. There is no time limit in law to revise TDS return. in that case can TDS return be revised and fresh TDS certificate be issued? and then claim refund from department?
3. is there a provision where deductor can claim TDS refund deposited in excess after 3-4 years?

20 September 2014 1. for refund of excess TDS deposited, you need to file Form 26B

2. any challan already booked is not unlocked for rebooking, so you might not be able to do as you suggest in point two.

So if return cant be revised (i am assuming you mean return cant be revised to change the amounts) then how would refund be claimed for TDS on excess amount. I mean deductor files form 26b thats it? moreover for which AY onwards is form 26b applicable?


20 September 2014 there is no restriction on AY for Form 26B

20 September 2014 Form 26B was introduced in 2013 so I am not sure if refund of TDS of earlier years can be claimed.
