Tution fees and deduction

16 April 2012 I have query on tution fees.

A person is getting tution fees paid reimbursed from the employer

in that case can he claim deduction under section 80 C after reimbusrment of the same.

please quote relevant case law/section.

16 April 2012 In my opinion, the tuition fees reimbursement is covered by Sec 17(3)(ii) of the Act and hence is a taxable perq. for the employee. The employee has to offer the same as taxable income and thereafter can claim deduction u/s 80C.

I want to add sec. 10(14) Children education allowance: Rs.100 per month per child upto a maximum 2 children.

I think Sec.10(14)also need to take while calculation of exemption and deduction and excess of this will take into 80C subject to maximum of 1 Lacs.


16 April 2012 Yes, agreed with experts. Rs.1200/- per child (up to 2 childeren) under section 10(14), & exemption of Taxable Perquisites under Sec.80C
