31 May 2012 NO he cannot( as i think).
if you are the auditor over there than check whether the funds are taken in the name of director first and than given the firm or dirctly to the firm.
Even if the fund is routed via director check dir having debit bal....so apply sec 2(22)(e) deemed dividend.
