Tds on purchase of immovable property

08 April 2016 I have been purchased a Flat for the consideration of Rs. 90 Lacs in March 2015. I was forgot to deduct TDS on that transaction. Total amount paid to seller, and documents registered. Now I have received an intimation from CPC-TDS to deposit TDS. The Seller doesn't co-operate with me. He has been filed his IT Return for A.Y. 2015-16 and declare sold property in his return. Can I get his ITR copy, Computation of Income and make certificate from C.A. and submit it to department against non payment of TDS. Please reply as early as possible. Like � Reply � Mark as

08 April 2016 If seller is NOT cooperating with you, how can you get the ITR copy and computation from him?
And if you wish to get it from IT department, it is not possible to have it.
What you can do is, make an appeal /request to the IT department, admitting your mistake in the first place, secondly explaining that the return has been filed by the seller and TAX, id any has been paid by the seller......so there is NO any loss of revenue to IT Dept. So, please waive the interest and penalty for non filing of the TDS and TDS return.
