Tds notice of demand /correction statement

26 April 2012 Dear Sir ,

May I request you to help me in solving the following problem:

While filing revised TDS return(24Q) for the A.Y.2009-10 , we made correction in the Deductee details and Tax deposited challans and but TDS amount in salary details were not corrected.
So there was a short deduction in respect of the employee whose tax was deposited.
We have received notice of default u/s 201 and notice of demand u/s 156 for the same on 03.04.2012.
When we contacted the AO , were asked to correct the error which was corrected by filing revised TDS Return again.

The 26AS of the same person is showing the correct TDS deducted /Deposied.

Shall we file Appeal against the Order.

I shall be grateful if you advise me in this regard.

26 April 2012 Is that notice for 4th qtr. and you have deducted and deposited right amount but while filing original return you have made mistake after you have revised it also but not correction done in tds of employee so dept has found short deduction right ?


now first my advice is check once again that qtr. 24Q by downloading from tan a/c then carefully check that entry because there is two time confirmation of tds amount so if you found that or still having same data in revised tds return, you have to revised your return once again because dept. raised invoice what they have seen

kindly do that early then if you have another doubt then raised your query again

You have understood my problem. After making correction in TDS amount in salary we filed the revised TDS Return on 10.04.2012 after receipt of the Notice U/S 201 and u/s 156.
We sent a request yesterday for the Statement which sowed the correct entries therein.
Now what should be future couse of action , whether we should any Appeal or Order u/s 201 can be rectified us/ 154.
I shall be grateful for your guidance.


27 April 2012 if everything is as wanted then no need for any confirmation. you have corrected your mistake by revised return after receiving notice. so there is no need to do anything with knowing that always check each and every column & Row before file ok

now dept. is going very advance they know everything what we have filed/rectified. so they will know what you have did with notice

but my advice is to prepare your clarification about this matter and what kind of mistake happened and how we rectified it because it will use any clarification of future concern just keep in your place

27 April 2012 Thank you Mr.Murtaza Ji,

I have checked with the Deptt.though the Demand is deleted not the interest which is being charged from the date of deduction till date.Though the amount stands deposited.
I seel your guidance.
Please help.
