TDS deduction on salary

26 February 2010 Dear Sir,

We are new company started from Nov'09 have 105 employees and all the employees joined in Nov'09.

Now pls tell me if maximum employees don't want to declare their previous invome from salary, we will be defaulter for not to deduct the TDS in the absence of their details or what to do us to be on safer side.

26 February 2010 The company has to deduct TDS as per the law in force by asking the concerned employees u are only making things easier for them if they have a different view its their pain/pleasure.But ensure that the circular letter is sent to each person by name and collect acknowledgement of the receipt to protect company's interest.

27 February 2010 You can take declaration in form 12B. If they do not declare any income then you are in a safe position as you were not aware of the previous salary as per the declaration.

02 March 2010 Employee is not declaring the income of previous employment as form12C employer is no required to worry about that

04 March 2010 Form 12C is for furnishing Particulars of income under any head of income other than 'Salaries' and Form 12B is for Form for furnishing detail of income of previous employer during the year and not form 12C.
