Tds deducted by employer but employee not geeting credit

14 July 2012 Hello,kindly answer my query. My query is that in case of an employee if employer has deducted tds but employee is not getting credit of this tds in his form 26as then what is right of employee, how he can claim this credit

14 July 2012 He should remind the employer to get deposited the amount of TDS with the Central Govt. and file e TDS return.

In the absence of any response , the assessee may write to his as well as employer's Income Tax Officer, about the non depositing of his TDS amount by the employer. A suitable action will be initiated by the department on receiving any
complain in this regard.

However, credit can be taken only when it appears in form 26AS.

14 July 2012 Credit can be only taken when it will appear in 26AS.
TDS not shown in 26AS can be by many reasons, 1 wrong PAN, 2 non deposit of TDS, 3 rejection of return due to technical reason. So first ask to employer to check return and to revise if necessary.


14 July 2012 The employer is the best person to solve this issue either by filing the tds return or to correct the tds return if already filed.
