01 October 2007 1) An employer collected TDS from his employee say on 28th September;
2) What will be the last date to credit such proceeds to the Central Govt Account in this instant case?
3) If the employer does not do do so due to any reasons, what will be the remedy for the employee? Will the employer be held liable for his act? If so, what are all the liabilities?

01 October 2007 last date of credit of TDS is 7th of the next month of the month in which it is deducted, say in ur case if TDS is deducted on 28th sep then TDS to be credited upto 7th oct.
in case employer not deposited the same then the same salary on which TDS is not deposited will be a dissalowed expenses.

01 October 2007 The year in which TDS is paid that year the expenses can be claimed.


01 October 2007 What will be remedy for the employee? He has no duty to collect the said tax from his his salary and he is answarable to the Department.....

02 October 2007 The employee should produce his pay slip in support of the employer having deducted tax at source. It is for the department to recover the tax from the deductor. This has been held so in a recent case.
