09 July 2011 Sir,
An advocate has raised a bill of Rs. 10000 as fees, 1000 as clerical charges and 1000 as misc. expenses which amounts to 12000. Now the question arises should TDS be deducted on 10000 or 12000????????

09 July 2011 but sir according to the advocate Rs. 2000 i.e. expenses will be reimbursed & Tds should be deducted on his fees i.e. Rs. 10,000.

09 July 2011 there is only one bill for the both so tds would be deducted on rs 12000.

09 July 2011 If this is the only bill of the advocate in a financial year, no need to deduct income tax under section 194J since it is less than the threshold limit of Rs.20000/-. Otherwise, as Mr. Navin righly said, deduct on Rs.12,000/-.
