A TELECOME DISTRIBUTOR GETS COMMISSION INCLUDING THE COMMISSION OF THE RETAILERS, WHICH DISTRIBUTER WILL TRANSFER TO THEM LATER. TDS IS DEDUCTED ON TOTAL COMMISSION(DISTRIBUTOR+HIS RETAILERS)IN THE NAME OF DISTRIBUTER. AS THE RETILER PORTION WILL BE TRANSFERED TO THEM, CAN THE DISTRIBUTER CLAIM TAX REFUND, FOR RETAILER PORTION OF TDS DEDUCTED IN HIS NAME.

There is no provision in law to claim refund portion wise as has been asked by u. The distributor has to file income tax return in which credit for the entire TDS can be claimed and if it is more than the tax payable, department will issue refund to the distributor.

You have to file IT Return and if your income is nil dept. will give you refund otherwise your tax less your Tds if your tds is morethan tax you can claim Balance TDS only.

sir my question is, TDS on retailer commission is deducted in the name of distributor.now what distributor should do? 1.claim refund from department. 2.pass on the tds deduction to the retailer

You System is like Deduction of TDS is on your Retailer so Company give 16A to Retailer name & PAN. so he/she is able to claim the refund. what you should have to do talk with your retailer if he/she is your higher post and told him/her to inform company to deduct tds on my/distributor name,if company accept. your problem will be solved.
